Driving Conviction or Sentence Appeals


Richard Freeman is happy to advise solicitors, and those who feel they have been wrongly convicted or sentenced, on the prospects of winning an appeal, and to lodge an appeal against sentence and/or conviction in the Sheriff Appeal Court for summary cases, and in the High Court for solemn conviction and sentence appeals.

He has extensive experience as a solicitor advocate in the High court, which combined with his expert knowledge in road traffic cases, makes him well positioned to provide a clear and straight forward written opinion, and to represent appellants in the Appeal Courts.

We offer a fixed fee arrangement for summary appeals, which is broken down for each part of the appeal process depending on whether it is a sentence appeal or conviction appeal.



SENTENCE APPEALS:

1) Examining all papers, and evidence where available, and providing a written opinion on the prospects of success, in particular if the sentence is excessive or incompetent.

2) Preparing a note of appeal for a summary sentence if the appeal is state able and applying for interim suspension of disqualification or forfeiture.

3) If case proceeds through the sift drafting a Case and Argument with appropriate legal authorities.

4) If appeal refused at first sift, drafting and lodging an appeal to the second sift.

5) Representing client at Appeal Court



CONVICTION APPEALS:

1) Preparing an application for a Stated Case for an appeal against conviction, and lodging same at court.

2) Perusing Draft stated case and preparing adjustments and attending any hearing on adjustments.

3) If case proceeds through the sift, preparing prints and lodging with Appeal Court.

4) If case is refused at first sift, drafting and lodging an appeal to the second sift.

5) Representing appellant in the Appeal Court.

It is vital that early contact is made as summary appeals require to be lodged within 7 days of the final determination of the case.
